Resale Certificates (Previously known as Disclosure Packet)

Per the Virginia Property Owners’ Association Act § 55.1-1808, an owner selling a lot shall disclose in the contract that (i) the lot is located within a development that is subject to the Property Owners’ Association Act (§ 55.1-1800 et seq.) and (ii) the Property Owners’ Association Act (§ 55.1-1800 et seq.) requires the seller to obtain from the property owners’ association an association disclosure packet and provide it to the purchaser. To request a resale certificate for either a residential or commercial property, please register at FirstService (welcomelink.com). Once you are registered, you can order the disclosure.

Once the request is received:

  • A Compliance Specialist will go out to the property to inspect and take pictures of the property in its entirety.
  • A violation report will be written up stating the property is either in compliance or is not in compliance. Whatever is noted on this report, in the eyes of the Association, will not affect closing. Any items that are not taken care of will be transferred to the purchaser.
  • Other items that are included in the resale packet are the following: accounting letter, Board meeting minutes, governing documents, residential/commercial design standards, budget, and insurance information.
  • A re-inspection of the property is not required unless the seller or buyer would like an updated report. If a re-inspection or updated financial information is needed, please go back through WelcomeLink to order.

CHECKLIST FOR PREPPING PROPERTY TO SELL:

  • Make sure any modifications to the house or property have been approved by the ARB
  • Trash and recycling cans need to be placed in an enclosure/screening
  • Front walkways need to be hard surfaces per the Residential Design Standards; asphalt is prohibited.
  • All landscaping beds need to be edged
  • All chipping paint needs to be touched up/repainted.
  • All mold/dirt needs to be cleaned off siding, driveways, mailboxes, roofs, etc.
  • All wooden steps facing the road need to have risers that are painted.
  • Any porch that is higher than 12”, needs to be screened underneath.
  • Along the front of the house, foundation plants are needed
