Board of Directors Election Voting is Open!

Voting for the Board of Directors election is now open and will remain available through April 22 at noon. You may vote online or by paper ballot.

Please check your email, as VoteHOA has sent everyone a registration PIN and a link to the online voting platform. Be sure to check your spam or junk folders. To ensure you receive this email, please add [email protected] to your safe sender list.

Keep an eye out, as an annual meeting packet will be mailed to you. If you prefer to vote by paper ballot, it will be included in this mailing. Complete instructions and additional information are provided in these materials.

Amendments

The Board of Directors is proposing amendments to the Brandermill Community Association Declaration, which will be included in the First Addendum to the Fourth Amendment if approved by owners.

Key Proposed Amendments:

1.Self-Maintained Public or Commercial Units

  • Current language requires owners to provide all maintenance and services at a level equal to that provided by the Association, with payments to the Association if they fail.
  • Proposed change: Simplifies and clarifies the definition: owners of these units handle all maintenance and submit an Association-approved maintenance plan annually, with a new plan required when ownership changes.

What You Will See on the Ballot:

DEFINITIONS- Article I (L), of the Declaration, as stated below, is hereby rescinded in its entirety and replaced with the proposed language as Article I (L) of the Declaration.

Current language:

L. Self-Maintained Public or Commercial Unit. “Self-Maintained Public or Commercial Unit” shall mean any Public or Commercial Units and Development Unit Parcels the Owner of which (i) establishes a plan of maintenance approved by the Association on an annual basis and (ii) enters into an agreement with the Association agreeing that it will provide all services to its parcel which the Association otherwise would have provided and all maintenance of its parcel at a level not less than that furnished by the Association to the Common Properties; and upon its failure to provide such services and maintenance, to pay to the Association an amount equal to the assessments paid by a Public or Commercial Unit for the time period such failure of services and maintenance continues.

Proposed language:

L. Self-Maintained Public or Commercial Unit. “Self-Maintained Public or Commercial Unit” shall mean any Public or Commercial Units and Development Unit Parcels that handles all the maintenance and establishes a plan of maintenance approved by the Association on an annual basis. With a change of ownership, a plan must be submitted starting for the next calendar year.

2. Member in Good Standing

  • New definition clarifies criteria for a member to be “in good standing,” including:
  • All assessments, dues, and fees are current
  • No unresolved covenants, conditions, and restrictions (CC&Rs) or bylaw violations
  • Not involved in pending or threatened legal disputes with the Association
  • No suspension of rights to use common property facilities after proper notice and due process

What You Will See on the Ballot:

DEFINITIONS: Member in Good Standing – The following proposed language is added Article I (U), of the Declaration states:

U. Member in Good Standing. A Member is considered “in Good Standing” if (1) All association assessments, dues, fees, and other monetary charges levied by the BCA are current meaning there are no financial obligations that are delinquent. (2) They have not been provided notice of any outstanding violations of the BCA’s covenants, conditions, and restrictions (CC&Rs) or bylaws, for which the deadline provided in such notice to bring such violation into compliance has passed. (3) They are not a party to any pending or threatened legal dispute with the Association or in which the Association is an adverse party. (4) Their rights to use Common Property facilities have not been suspended after appropriate notice and Due Process.

*Owners will vote to either approve/ratify/agree, or oppose/reject/disagree with these changes.
