Resale Certificates (Disclosures)

Under the Virginia Property Owners’ Association Act § 55.1-1808, any owner selling a property must disclose in the contract that:

  1. The lot is part of a development governed by the Property Owners’ Association Act (§ 55.1-1800 et seq.)
  2. The Act requires the seller to obtain a resale certificate (association disclosure packet) from the property owners’ association and provide it to the purchaser.

Requesting a Resale Certificate

To request a resale certificate for residential or commercial property:

  1. Register at FirstService (welcomelink.com): https://secure.welcomelink.com/resale/index.cfm?mg=AS
  2. Once registered, you can order the disclosure packet.

What Happens After a Request

Once your request is received:

  • A Compliance Specialist will inspect the property and take photos of the entire site.
  • A violation report is created, noting whether the property is in compliance. Items noted do not affect closing; unresolved issues are transferred to the purchaser.
  • The resale packet also includes:
    • Accounting letter
    • Board meeting minutes
      Governing documents
    • Residential/Commercial Design Standards
    • Budget and financial information
      Insurance information
  • Re-inspection is optional. If the seller or buyer wants an updated report or financials, re-order through WelcomeLink.

Property Preparation Checklist

Before selling, ensure your property meets these standards:

  • Any modifications to the home or property must be ARB-approved
  • Trash and recycling cans must be in an enclosure or screened
  • Front walkways must be hard surfaces (asphalt is prohibited)
  • Landscaping beds should be edged
  • Chipping paint should be repaired or repainted
  • Mold and dirt should be cleaned from siding, driveways, mailboxes, roofs, etc.
  • Wooden steps facing the road should have painted risers
  • Porches higher than 12” must be screened underneath
  • Foundation plants are required along the front of the house
