Minutes - March 20, 2006

I. CALL TO ORDER - The March 20, 2006 meeting of the BCA Board of Directors was called to order by President Giordano at 7 PM in the meeting room of Brandermill Woods, 14311 Brandermill Woods Trail, Midlothian, VA 23112. President Giordano, Directors Bradner, Cook, Gibbons, Livingston, Reamy and Whitfield, Community Manager Pritz and recorder Judy Agee were present.

II. THORNRIDGE NOISE ABATEMENT – John McCracken – John McCracken, Chesterfield County Transportation, Dale Totten, VDOT, two representatives from Earth Tech and county transportation staff presented a noise abatement study that was done on the area of the Thornridge neighborhood which runs parallel to Route 360 West. A standard VDOT concrete wall would be installed for the noise abatement. The county will send letters to the Thornridge residents who would be impacted by the noise abatement wall for their approval.

III. MEMBER VOICE – Joshua Lief, attorney with Sands, Anderson, Marks & Miller, represented 12 Harbour Pointe residents and he expressed their concerns regarding the lack of communication from the board to the residents about the reasons for moving the marina and the chosen location. He recommended the board delay any action for one month to either allow further communication with the Brandermill Inn for possible permanent placement of the marina at that location or to continue the search for the best location.
- Joe Herbst, resident of Harbour Pointe, expressed concern that the board was not forthcoming with information regarding moving the marina and recommended delaying the decision for the move.
- David McPherson, resident of Harbour Pointe, said he felt that a lot of information regarding the marina move has been blown out of proportion and that he backs the decision of the Board of Directors with any location the board chooses.
- Graham Henderson, resident of Harbour Pointe and a member of the marina advisory committee, gave an update of the estimated costs of moving the marina to both the Harbour Pointe and Sunday Park north locations.
- Pat Goldberg, resident of Northwich near Sunday Park, expressed concern against Sunday Park being considered as a location for the marina since it already has a lot of bright lights and noise coming from Sunday Park.
- John Borden, resident of Shallowford Landing and a member of the first ad hoc committee formed to review moving the marina in November 2005, backs the board’s decision to move the marina to Harbour Pointe and is waiting to hear the recommendations of the marina advisory committee during this meeting.
- Chuck Rayfield, resident of Shallowford Landing, wanted to thank the board members for their volunteer work and backs the decision of the board in the move of the marina to BCA property. The current marina members represent 28 neighborhoods of Brandermill and one-third of the members live in Harbour Pointe. The marina renters pay for the marina and would pay for the move therefore an assessment increase would not be needed to move the marina. There would not be any traffic and noise issues since most boaters would be back in by 11 PM. As chairman of the environmental committee, he noted there would be no environmental issues since all boats would have an electric motor and there would be no land disturbance. He has been told by a real estate agent that a marina would increase the value of the nearby homes.

IV. PRESIDENT’S REPORT – The President reported the rezoning for Celebrations has been deferred.

V. TREASURER’S REPORT – The Treasurer reported that he is reviewing the revised reserve study and he will have a report at the next meeting.

VI. COMMITTEE REPORTS –
A. ARB/CARB/Hearing Panel – The Community Standards Department report was reviewed as attached.
B. Activities – No report given.
C. Environmental – No report given.
D. Finance – No report given.
E. LRPC – No report given.
F. NRC – No report given.
G. Pool - The Pool Committee will meet to discuss the survey to be conducted concerning universal access to the pools.

VII. MOTION TO APPROVE MINUTES – March 6, 2006
MOTION: Director Whitfield moved to approve the minutes of the March 6, 2006 meeting, as amended.
MOTION SECONDED: Director Bradner.
MOTION CARRIED: Unanimously

VIII. MANAGER’S REPORT - Community Manager Pritz highlighted her written report.

IX. MARINA REPORT - Director Livingston presented a chronological overview of the activities involved in relocating the BCA Marina, highlighting the extensive efforts which had been made by the board to negotiate an extension of the existing lease with the Brandermill Inn and to secure community input to the decision making process. Directors Bradner and Reamy gave a review of the Marina Relocation Advisory Committee, Draft Report of Findings and Recommendations, including the revised costs.


MOTION: Director Livingston made the following motion:
Resolved, that the Board adopt the Marina Advisory Committee recommendations contained in Section VI A. 1-4 and B. - (Summary of Recommendations).
Further Resolved, that the Brandermill Community Association (BCA) will seek an extension of the current lease with the Brandermill Inn of 90 days. If the Brandermill Inn does not provide adequate written assurances of such 90-day extension to the BCA by 5:00 PM March 27th, then the BCA authorizes Community Manager Pritz to enter into an agreement with Harbor Dredge & Dock to relocate the marina to the Harbour Pointe site and add 20 additional slips consistent with the Marina Advisory Committee’s recommendations contained in paragraphs VII A. 1 (A-H) for Harbour Pointe. Such written assurances from the Brandermill Inn due on March 27th shall also include the Inn’s proposed terms for a long-term lease with renewals.
Further Resolved, that if the Inn and the BCA have not made substantial progress toward a long-term lease arrangement by May 2, 2006, defined as submission of an executed lease agreement to the Bankruptcy Court for approval, then the BCA authorizes Community Manager Pritz to engage contractors to relocate the marina consistent with the Marina Advisory Committee recommendations as set forth above.
MOTION SECONDED: Directory Reamy.
MOTION FAILED: Directors Bradner, Livingston and Reamy approved, President Giordano, Directors Gibbons and Whitfield opposed and Director Cook abstained.

MOTION: The previous motion was recalled by Director Livingston.

I. CALL TO ORDER - The March 6, 2006 meeting of the BCA Board of Directors was called to order by President Giordano at 7:20 PM in the meeting room of Brandermill Woods, 14311 Brandermill Woods Trail, Midlothian, VA 23112. President Giordano, Directors Bradner, Cook, Gibbons, Livingston, Reamy and Whitfield, Community Manager Pritz and recorder Judy Agee were present.

II. MEMBER VOICE – No members were present.

III. MOTION TO APPROVE MINUTES – February 20, 2006
MOTION: Director Livingston moved to approve the minutes of the February 20, 2006 meeting, as amended.
MOTION SECONDED: Director Reamy.
MOTION CARRIED: Unanimously

IV. PRESIDENT’S REPORT – The President highlighted his written report.
President Giordano wanted the record to reflect that the board had a moment of silence for the tragic loss of two Brandermill residents: Jordan Sebia and Travis Turner. (The boys apparently capsized while canoeing on Swift Creek Reservoir on February 26, and their bodies were recovered March 5 and 6, respectively.)

V. TREASURER’S REPORT – Director Whitfield reported that the Accounting Manager is assisting the auditors Tom Koren and Tom Kennedy with the annual audit, as noted in the Manager’s Report.

VI. MANAGER’S REPORT - Community Manager Pritz highlighted her written report. President Giordano suggested making contact with the state legislators in early April regarding VDOT budgeting for street resurfacing.

VII. MARINA COMMITTEE UPDATE – Joel Bradner - The Marina Committee has been meeting; its members are: BCA Board of Directors Ryland Reamy and Joel Bradner, who is chair of the committee; Harbour Pointe residents Tom Anderson and Graham Henderson; Marina member Tommy Baer; Sunday Park area residents Richard Gallagher, in Gleneagles, and Richard Johndrow, in Long Shadow; and Community Manager Jane Pritz as advisor and coordinator of BCA activities. The approved minutes of the first committee meeting on February 27th and the draft of minutes of the March 2nd meeting were distributed to each board member. The focus has been on the comparison of the Harbour Pointe and Sunday Park North sites. Based on information from the February 22nd meeting with county representatives regarding the Sunday Park South site, the consensus of the committee was that the site would be tabled from the discussion so that they could focus on the two other sites. Paul Smith with Harbor Dredge & Dock attended the March 2nd meeting. He explained some technical issues and construction concerns at both sites and provided alternate drawings of the configuration as it could be placed at Harbour Pointe. Committee member Graham Henderson, who is a structural engineer, provided an alternative drawing for the Sunday Park North location which Mr. Smith is evaluating. Mr. Smith will provide at the committee’s March 8th meeting suggestions as to what will be required to create equivalent safety and durable construction in both locations with associated costs. Another committee meeting is scheduled March 13th, with March 15th as the date to decide recommendations and best estimates for the final report to be given at the board meeting scheduled March 20th. All committee members agreed that a fair and equitable process was being followed.

VIII. SET ANNUAL MEETING DATE & APPOINT DIRECTOR OF ELECTIONS
MOTION: Director Livingston moved to set the annual meeting date for April 17, 2006 and appoint Community Manager Jane Pritz as Director of Elections.
MOTION SECONDED: Director Reamy.
MOTION CARRIED: Unanimously

IX. CVS - PROPOSED TRAFFIC PATTERN – President Giordano reviewed several traffic flow patterns concerning egress from the parking lot for the CVS location, the board had no recommendation. A new traffic study for the Genito and Charter Colony intersection will be requested from the county. President Giordano obtained from the county the February 15, 1974 zoning map of Brandermill, master plan phase I, which notes this parcel is zoned as B-2 Commercial.

X. NRC COMMITTEE MEMO – President Giordano reviewed an email concerning the NRC Committee report sent to the board regarding the Arts in the Park event. It was the consensus of the board to have Mr. Healy, NRC chair, discuss this with all NRC members and get a statement as to how the decision was made. Director Gibbons, as board liaison with the NRC, will follow-up with Mr. Healy and give a report at the next board meeting.

Transportation Director McCracken discusses Thornridge noise issues

Chesterfield Director of Transportation John McCracken and representatives from Earth Tech, an engineering consulting firm, were present at the March 20 BCA Board meeting to report the findings of a noise study conducted on 14 homes and 15 lots in the Thornridge neighborhood area. Thirteen to 15 properties were found to be noise impacted by the traffic on U.S. Route 360.

The highest reading from the noise impact study was reported at 68 decibels. McCracken said the noise reduction that would occur with the construction of a noise abatement wall would be between 5 and 10 decibels. The wall, McCracken said, would be constructed from concrete, and would cost between $250,000 and $500,000—the higher number reflecting the cost of moving and relocating utilities.

However, McCracken said the wall would have to be constructed concurrently with the widening of U.S. Route 360 and that monumental undertaking has encountered a snag. The bids submitted by out-of-area contractors are nearly double what was anticipated, and the local road contractors are simply too busy with other projects to take on the U.S. Route 360 expansion.

In the end, McCracken noted, the majority of residents in the Thornridge neighborhood would have to be positively impacted by the noise abatement wall in order for the construction to proceed.
